Terms of Service

Welcome to Bajar. These terms govern your use of thebajar.com (the “Service”), a marketplace for digital craft files such as embroidery designs, operated by Bajar (“we”, “us”). By creating an account or using the Service you agree to these terms.

1. What Bajar is

Bajar is a venue: sellers list and sell their own digital files, and buyers purchase from those sellers. We provide the platform, file delivery, generated previews (such as stitch-out animations), and payment processing — we are not a party to the sale between buyer and seller, and we do not create or review the designs sold.

2. Accounts

  • You must be at least 18 years old (or the age of majority where you live).
  • Provide accurate information and keep your login credentials secure. You are responsible for activity on your account.
  • We may suspend or terminate accounts that violate these terms.

3. Buying

  • Purchases are processed by Stripe. We never see or store your card number.
  • Digital files are delivered immediately after purchase via your account.
  • License: unless the listing states otherwise, buying a design grants you a non-exclusive, non-transferable license to use it — including stitching or producing physical items and selling those finished physical items. You may not resell, share, sublicense, or redistribute the digital files themselves, in original or modified form. Where a listing states its own license terms, those control.

4. Refunds

Because digital files are delivered instantly and cannot be returned, all sales are final, except when a file is not delivered, is corrupt or unusable, or is materially different from its listing description — contact us within 14 days of purchase and we will make it right. By purchasing, you expressly consent to immediate delivery of the digital content and acknowledge that you thereby lose any statutory right of withdrawal that depends on delivery not having begun.

5. Selling

  • Payouts are processed by Stripe Connect. To sell, you must complete Stripe onboarding and accept the Stripe Connected Account Agreement.
  • Fees: we charge a platform fee (currently 2% of the sale price); payment-processing fees are deducted from the remainder. Promotional fee terms (e.g. founding-seller agreements) are honored as written. We may change fees with 30 days' notice.
  • You are responsible for your own taxes on your sales.
  • You must own it: only upload designs you created or hold the rights to sell. Uploading others' designs is grounds for immediate removal and account termination.
  • License to us: you grant Bajar a non-exclusive, worldwide, royalty-free license to host, reproduce, and display your uploaded content, to generate previews and derivative renders of it (including stitch-out animations), and to use those listing previews and animations to promote your listings and the Service, including on social media. This license ends for content you delete, except as needed to serve buyers who already purchased it.
  • Archiving or deleting a listing does not revoke access for buyers who purchased it.

6. Copyright & DMCA

We respond to copyright infringement notices and terminate repeat infringers. The full procedure — what a takedown notice must contain, how sellers can counter-notice, and our repeat-infringer policy — is our DMCA & Copyright Policy.

7. Prohibited conduct

  • Uploading content you don't have the right to sell, or content that is unlawful, infringing, or malicious (including malware in files).
  • Circumventing fees, scraping the Service, or interfering with its operation.
  • Misrepresenting listings, reviews, or your identity.

8. Disclaimers & liability

The Service is provided “as is” without warranties of any kind. Designs are sold by their sellers; we do not warrant their quality, stitchability, or fitness for a purpose. To the maximum extent permitted by law, our total liability for any claim arising from the Service is limited to the greater of $50 or the amounts you paid us in the 12 months before the claim. You agree to indemnify us against claims arising from content you upload or your breach of these terms.

9. Changes & termination

We may update these terms; material changes will be announced on the Service or by email at least 14 days before taking effect. You may close your account at any time by contacting us; sections that by their nature survive (licenses to already-sold content, liability limits, indemnity) survive termination.
